All users must read the terms presented herein and accept them before using the services and systems offered by C4F, this website.

1. Terms Used

   1. C4F: Refers to this website, Coding4Free.net
   2. Cookie: A small piece of text stored on the user's computer by the website and containing data regarding authentication, session handling, and browsing experience of the website user.
   3. User: Refers to registered members of this web site.
   4. Freelancer: A registered user who takes on projects posted by outsourcers.
   5. Outsourcer: A registered user who gives out projects to be completed by freelancers.
   6. Voluntary work: Work done solely for gaining experience, and final submission of work provided without any conditions set on payment for work.
   7. Final submission: The final piece of work submitted or expected to be submitted by the voluntary developers that meets the given specification criteria.

2. Terms of Posting

   Without exception, all users must abide by the following terms and conditions when using the contact forms and internal bulletin boards offered by C4F:

   1. You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed). The IP address of all posts is recorded to aid in enforcing these conditions;
   2. You agree that the webmaster, administrator and moderators of C4F have the right to remove, edit, move or close any project or posts at any time should they see fit.
   3. As a user you agree to any information you have entered above being stored in a database. While this information will not be disclosed to any third party without your consent the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised.

3. Terms of usage: Freelancers

   1. You, the freelancer, understand and acknowledge that you are solely responsible for any information that you supply in regards to your developer's profile on our website. Do not include text, images or links that are defamatory, libellous, lewd or in bad taste, ensuring that your profile is accurate, truthful and complies with English law; including but not limited to those governing consumer protection and false advertising. In uploading information to compile your developer's profile you warrant that you own or otherwise control all of the rights to the content of your profile and agree not to infringe any third party's copyright, IP, patent, trademark, trade secret or other rights of publicity or privacy.
   2. C4F does not claim ownership of any information you upload to the web site. However, by uploading and submitting such information you are granting C4F permission to use such information in connection with the operation of our internet businesses, including, without limitation, the license rights to: reproduce, distribute, transmit, publicly display, edit and reformat your profile and to publish your name in connection with your profile. You acknowledge and agree that we may amend any information you provide to us as part of your profile at our sole discretion.
   3. You, the freelancer, understand and acknowledge that you are registering to provide voluntary services to outsourcers. In accordance with the guidelines set, you will not attempt to exhort funds and/or other incentives and payments from the outsourcing party unless the outsourcing part explicitly agrees to award you the said incentive. You will not, therefore:
      1. Make a request or requests for a payment from the outsourcer unless the outsourcer has explicitly allowed an incentive to be awarded upon the completion of the project,
      2. Withold the final submission piece in exchange for a payment or other incentive unless this has been explicitly agreed and there is evidence to suggest likewise on the website communication log.

4. Terms of usage: Outsourcers

   1. You, the outsourcer, understand and acknowledge that you cannot claim a refund on the listing fee once it has been processed.
   2. You, the outsourcer, understand and acknowledge that C4F cannot be held liable for any discrepancies in the work offered by freelancers

5. Terms of usage: General

   1. You are entirely responsible for maintaining the confidentiality of your log in details and password to access your account, which should not be distributed or disclosed to third parties.
   2. You acknowledge that C4F reserves the right to refuse or terminate your membership at any time, without notice, for any reason whatsoever.
   3. C4F is not party to any contract entered into between outsourcers and freelancers, and cannot therefore be held liable for such issues.
   4. You will not use the network to circulate viruses, trojan horses, worms or any other computer malware.
   5. You agree that we may be required to disclose your personal data to applicable legal and regulatory authorities.
   6. We may add, delete or modify some or all of our services and information contained on any part of the website at any time without prior notice.
   7. You hereby acknowledge the terms mentioned herein and release C4F from any damages or liability whatsoever relating to your membership of, the services offered by and any information contained on the C4F website, including, without limitation, lost business opportunities, lost data, disputes with or any negligent, intentional wrongdoing by other C4F members, or otherwise, even if C4F has been advised of the possibility of such damages. The exclusion contained in this paragraph shall apply regardless of the failure of any remedy.
   8. Furthermore, you agree to indemnify C4F in respect of all liabilities incurring as a result of your membership and developer's profile and in particular as a result of the publication of any defamatory or discriminatory statements, or where your profile infringes any third party's copyright, IP, patent, trademark, trade secret or other rights of publicity or privacy.
   9. These terms and conditions (both express and implied) shall be governed and enforced under English law and the parties hereby submit to the exclusive jurisdiction of the English courts.
   10. The invalidity or unenforceability for any reason of any part of these terms shall not prejudice or affect the validity or enforceability of the remainder.
